Welcome to 3aiasia. These Terms of Service ("Terms") govern your access to and use of our AI image generation platform, website, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
By creating an account, accessing, or using our Services, you affirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
To use certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access or security breach.
We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that harm our Services or other users.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your internal business or personal purposes.

You retain all rights to the text prompts and content you submit to our Services. By using our Services, you grant us a worldwide, non-exclusive license to use, store, and process your content to provide and improve the Services.
Subject to your subscription plan:
The Services, including all software, AI models, algorithms, and related technology, are owned by 3aiasia and protected by intellectual property laws. You may not copy, modify, or distribute any part of our Services without written permission.
We offer various subscription plans with different features and usage limits. You agree to pay all fees associated with your selected plan.
Subscription fees are billed in advance on a monthly or annual basis. By providing payment information, you authorize us to charge the applicable fees to your payment method.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods, except as required by law.
We may modify subscription prices with 30 days' notice. Continued use of the Services after price changes constitutes acceptance of the new pricing.
Our collection and use of personal information is governed by our Privacy Policy. By using the Services, you consent to such processing and warrant that all data you provide is accurate.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee the accuracy, quality, or suitability of AI-generated content. You are solely responsible for reviewing and validating generated content before use.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3AIASIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless 3aiasia, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services or violation of these Terms.
These Terms are governed by the laws of Singapore, without regard to conflict of law principles.
Any disputes arising from these Terms shall be resolved through binding arbitration in Singapore, except where prohibited by law. You waive the right to participate in class action lawsuits.
We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Your continued use after such notice constitutes acceptance of the modified Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and 3aiasia regarding the Services.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

You agree to comply with all applicable export and import laws and regulations. You may not use the Services in countries subject to U.S. or international sanctions.
For Enterprise customers, specific uptime guarantees and support response times are detailed in your separate Enterprise Agreement. Pro plan customers receive a 99.5% uptime target on a best-effort basis.
